Appeals Court Reverses Ban on Public Carry of Guns in California

A federal appeals court decision on Saturday intervened in California’s efforts to enforce a new law banning the carrying of guns in most public places, citing concerns of unconstitutionality. The 9th U.S. Circuit Court of Appeals dissolved a prior order, allowing a judge’s ruling to take effect.

Despite a previous 9th Circuit panel’s order temporarily lifting the injunction against California’s gun ban, a different panel reversed the decision on Saturday. This move followed arguments that the state law infringed upon citizens’ Second Amendment rights.

Temporary Suspension Lifted

Last week’s order, which had temporarily suspended the injunction, enabling the law to take effect on January 1, was overturned by the latest appeals court ruling. Gun rights advocates celebrated the decision as a setback for what they deemed a violation of the Second Amendment.

Gun Rights Advocacy

C.D. Michel, representing the gun rights groups, remarked, “So the politicians’ ploy to get around the Second Amendment has been stopped for now.” The legal battle continues as California appeals the injunction, scheduled to be heard in April.

State’s Argument and Reaction

California’s Attorney General argued in court papers that blocking the law would expose tens of millions of Californians to an increased risk of gun violence. The decision was criticized by Governor Gavin Newsom’s spokesperson, Daniel Villaseñor, who expressed concerns about jeopardizing lives.

Enacted after a pivotal Supreme Court ruling in June 2022, California’s law followed the Supreme Court’s decision in New York State Rifle & Pistol Association v Bruen. The landmark ruling expanded gun rights nationally, asserting the right to carry a handgun in public for self-defense.

New Constitutional Test

The Supreme Court’s decision in Bruen set a new standard for assessing the constitutionality of gun laws, requiring them to be “consistent with the nation’s historical tradition of firearm regulation.” In response, California, aligning with other states, sought to adjust its regulations.

Restricted Zones

Under California’s law, individuals were prohibited from carrying concealed guns in 26 categories of “sensitive places,” including hospitals, playgrounds, stadiums, zoos, and places of worship. This restriction applied irrespective of whether the individuals held permits to carry concealed weapons.

Senate Bill 2, the law in question, extended its restrictions to privately owned commercial establishments open to the public. Unless businesses posted signs allowing licensed gun holders to carry on their premises, concealed guns were not permitted.

U.S. District Judge Cormac Carney, appointed by former President George W. Bush, sided with permit holders and gun advocacy groups in declaring the law unconstitutional under the Second Amendment on December 20.
