Discussion on Indictment
Dershowitz highlighted that the indictment claims Donald Trump believed he lost the election and everything he did was fraudulent. However, he pointed out that there is no smoking gun or credible testimony indicating that Trump personally admitted to losing the election. He emphasized that proving such claims might be challenging.
Concerns Over Jury Pool
Dershowitz raised concerns about the jury pool in the District of Columbia, where 90 percent reportedly voted against Trump. While a conviction might be possible from a D.C. jury, he expressed doubts about its survival during appellate review and review in the Supreme Court.

Expectations for the Appeals Process
Dershowitz believes that Trump may lose in the D.C. Circuit’s state court of appeals. However, he is optimistic that Trump will likely win in the United States Supreme Court if they grant review, and he believes they should grant it.
