Hunter Biden’s Legal Team Considers Response to House Oversight Committee Subpoena as James Biden Cooperates with GOP Panel

President Joe Biden’s son, Hunter Biden, has been issued a subpoena by the Republican-led House Oversight Committee. The subpoena, issued in early November, requires Hunter Biden to appear for a closed-door transcribed interview on December 13th.

Hunter Biden’s legal team has acknowledged receipt of the subpoena but has not yet responded. Meanwhile, James Biden, the president’s brother, has been cooperating with the committee and is scheduled for an interview on December 6th.

Typically, the legal teams of witnesses called before congressional committees negotiate the terms of their appearance. Witnesses have the option to plead the Fifth Amendment, request a public hearing, or challenge the subpoena in court.

Hunter Biden’s team has not revealed their strategy at this time. However, they must consider not only their obligation to comply with the congressional subpoena but also Hunter Biden’s legal exposure.

He currently faces gun charges and potential tax charges, with any testimony given in a congressional hearing potentially admissible in a future criminal trial.

Hunter Biden’s lead attorney, Abbe Lowell, declined to comment on the status of the subpoena. Representatives for James Biden also did not provide any comments. Representative James Comer, Chair of the House Oversight Committee, issued the subpoenas as part of an investigation into the Biden family’s business dealings.

The committee requested thousands of bank records related to Hunter and James Biden, other family members, and various business associates.

The committee is actively working to finalize the depositions, and Comer expects full compliance with the subpoenas. The Oversight Committee’s inquiry extends beyond Hunter and James Biden, with subpoenas and interview requests also sent to other members of the Biden family and their associates.

Rob Walker, a key witness in the investigation, has already met with the FBI and testified in a 2020 interview that President Joe Biden was not involved in their activities.

The White House has questioned the legitimacy of the subpoenas, describing them as an improper attempt by the House GOP to weaponize Congress’s powers. White House counsel Richard Sauber sent a letter expressing these concerns. Democrats on the House Oversight Committee, along with their spokesperson Joe Costello, have also criticized Comer’s actions, calling it an abuse of authority.

In response, Comer has affirmed the committee’s intent to enforce its subpoenas. He stated that the evidence obtained so far has debunked Republicans’ claims and that the committee will question members of the Biden family and their associates to provide transparency and accountability to the American people.
