Rep. Stefanik Accuses Special Counsel Jack Smith of Rushing Trump Trial Before 2024 Elections, Files Ethics Complaint

Republican Congresswoman Elise Stefanik has lodged a formal ethics complaint against Special Counsel Jack Smith, alleging that his conduct in the investigation into former President Donald Trump is an attempt to influence the 2024 presidential election. 

This complaint, filed with the Justice Department’s Office of Professional Responsibility, marks a significant escalation in the ongoing political battle surrounding Trump’s legal challenges.

Stefanik accuses Jack Smith, who is spearheading the probe into Trump’s actions surrounding the January 6 Capitol riot and the 2020 election results, of deliberately trying to sway the upcoming election by targeting Trump. 

She claims that Smith’s actions are not only inappropriate but also illegal under Justice Department regulations.

The context of Stefanik’s complaint is rooted in the broader legal entanglements facing Trump. 

The former president faces four felony charges related to his alleged efforts to overturn the 2020 election outcome. 

These charges are currently in limbo as Trump has invoked an absolute immunity defense, which is awaiting a Supreme Court decision.

Stefanik took to social media platform X, formerly known as Twitter, to publicize her complaint and articulate her arguments. 

“It’s obvious to any reasonable observer that Jack Smith is trying to interfere with the 2024 election and stop the American people from electing Donald Trump,” she wrote.

She asserted that Smith’s aggressive pursuit of the case, particularly his efforts to proceed with a trial before the 2024 election, blatantly aims to prevent Trump from running again.

The congresswoman’s complaint highlights what she perceives as a disregard for judicial processes. 

She accuses Smith of continuing to engage in prosecutorial activities despite a court-imposed stay on the case, including the continued submission of discovery documents.

According to Stefanik, Smith’s actions have tarnished the reputation of the Department of Justice and the federal government at large. 

“Smith’s conduct has brought disrepute to the Department of Justice and the entire federal government, and the DOJ’s Office of Professional Responsibility should impose the discipline that such conduct warrants,” wrote Stefanik.

She argued that such behavior should be met with significant disciplinary measures from the Office of Professional Responsibility to restore integrity within the DOJ.

This is not the first time Stefanik has challenged figures involved in legal actions against Trump. 

She previously filed complaints against Judge Arthur Engoron during Trump’s civil fraud trial and called for his resignation, demonstrating her ongoing defense of Trump across multiple legal fronts.

The response on social media to Stefanik’s actions has been mixed. 

Supporters applaud her for taking what they view as bold and necessary steps to protect electoral integrity and support Trump. 

Conversely, critics accuse her of excessive partisanship and sycophancy towards the former president.
