In a decisive move, Republican Gov. Jim Justice vetoed legislation to soften vaccination mandates in schools in West Virginia.
The bill intended to carve out exemptions for students enrolled in extracurricular activities and those not part of the traditional public schooling system from mandatory vaccinations.
Governor Justice, who is currently eyeing a seat in the U.S. Senate, underscored the importance of child welfare in his veto explanation, citing West Virginia’s success in combating preventable diseases through its robust vaccination program.
He expressed his obligation to heed the advice of medical professionals, who largely opposed the bill, emphasizing the necessity of protecting children, whom he regards as the state’s most valuable asset.
The proposed bill had garnered support within both legislative chambers despite significant opposition from healthcare leaders, educators, and concerned parents.
It sought to exempt private and parochial schools from state vaccine mandates, allowing them to establish their own vaccination policies.
Additionally, students exclusively attending virtual public schools would have been exempted from the existing vaccine requirements.
Prominent health officials and organizations, including the state’s teachers unions, the West Virginia Hospital Association, and the West Virginia Medical Association, publicly denounced the bill.
Dr. Clay Marsh, a key figure in the state’s COVID-19 response, also recommended a veto, highlighting the potential risks associated with diluting vaccination mandates.

Governor Justice, who held a positive stance in favor of vaccination during COVID-19, faced pressure to maintain West Virginia’s rigorous vaccination standards.
Critics of the bill, like Kanawha-Charleston Health Officer Dr. Steven Eshenaur, warned of the dangers to children’s health and safety, starkly framing the debate as a choice between supporting vaccinations or endorsing disease.
The veto preserves West Virginia’s position as one of the few states offering very few exemptions to vaccination requirements, a policy hailed by health leaders as a model for other states seeking to bolster their immunization efforts.

Parental discontent over the state’s policies has been growing as calls for more autonomy over this decision increase.
While initially only public virtual school students were to be exempted, the bill ultimately expanded its scope to private schools and religious exemptions.
Despite the growth of anti-vaccine requirement groups within the state, Governor Justice’s veto reaffirms West Virginia’s commitment to child health and public safety through vaccination.
